Privacy Policy

Overview:

This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from http://www.luciahardy.co.uk (the “Site”).

1.    PERSONAL INFORMATION WECOLLECT

1.1   When you visit the Site, we may automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device.  Additionally, as you browse the Site, we may collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information.”

1.2   We may collect Device Information using the following technologies:

“Log files” track actions occurring on the Site, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.

“Web beacons,” “tags,” and “pixels” are electronic files used to record information about how you browse the Site.

1.3   Additionally when you make a purchase or attempt to make a purchase through the Site, certain information is collected from you, including your name, billing address, shipping address, payment information (including credit card numbers), email address, and phone number, and any additional order notes you have included.  We refer to this information as “Order Information.”

1.4   When you complete a contact form, send an email, message or speak to the artist; when you send a comment or communication via the artist’s Social Media accounts; or, when you ask to receive the art journal/newsletter, we may collect certain information from you, including your name, your email address and any additional information you have included in your enquiry.  We refer to this information as “Contact Information”.

1.5   When we talk about “Personal Information” in this Privacy Policy, we are talking about Device Information, Order Information and Contact Information.

1.6  This Site is run and hosted on Format.com. Please refer to their Privacy Policy at https://www.format.com/privacy_policy for additional details on how your information could be collected and used.

2.    HOW DO WE USE YOUR PERSONALINFORMATION?

2.1   We use the Order Information that we collect generally to fulfil any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with order confirmation, invoices or receipts).  

2.2   Additionally, we use this Order Information to:

·      Communicate with you;

·      Screen our orders for potential risk or fraud; and

·      When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.

2.3   We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).

2.4   We use the Contact information you have shared to communicate with you via:

·      The Artist Journal/Newsletter - in line with the preferences you have shared,

·      Additional notices of events and offers – in line with the preferences you have shared.

·      Adding your name and email and/or address to our collectors contact list.

·      Adding your name to our collectors log.

·      Specific or General Communication with you regarding your enquiry to the artist, and further issues related to your communications/preferences.

2.5   The artist reserves the right to retain and use name, email addresses and messaging  relating to contact information initiated by customers, unless the customer explicitly asks the artist to remove this. 

2.6   If Contact Information relates to a completed purchase (Order information) it will be treated in line with 6.4 below. 

2.7   If customers agree, their name, email address and/or address will be added to a collectors contact list which may be subject to exclusive collectors offers and notices.  At any time they can remove their email address from this list by contacting the artist here.  This record is called the ‘Collectors contact list.’

2.8   The artist reserves the right to retain a list of names of buyers indefinitely to log sales accurately. This record is called the Collectors Log.

2.9   The artist employs a GDPR compliant newsletter sign up methodology and maintains processes that support relevant, appropriate and fair data use.  Therefore if you sign up to the Artist Journal/Newsletter and or Additional notices of events and offers, and change your mind, you can unsubscribe at any time by informing the artist or following the links in each emailed edition. 

If you signed up to the email Artist Journal/Newsletter list in-person at an event or via direct message to the artist, your name will be directly added to the list at that time, or soon after. A record of your request information will be saved in line with Data Protection rules - either your request message/email will be saved, a record of your verbal consent after in-person payment, using the i-Zettle record keeping function, or physical records of clipboard sign up sheets, with your name visible, will be kept.    

3.    SHARING YOUR PERSONALINFORMATION

3.4   We also use Mailchimp.com to coordinate and disseminate the regular Art Journal/Newsletter – you can read more here about how Mail Chimp uses your personal information: https://mailchimp.com/legal/privacy/

3.5   Finally, we may also share your Personal Information to comply with applicable laws and regulations, to respond to a lawful request, subpoena, search warrant or other verified legal enquiry for information we hold, or to otherwise protect our rights.

3.6   Format, Paypal, i-Zettle and Mailchimp take significant measures to ensure their services are secure, however, I cannot beheld liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when using these services or this website.

3.8    I process the data you share with me directly and via the services above, securely and safely.  However, I cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data that I have retained to process your order, enquiry or subscription.

4.    DO NOT TRACK

4.1  Please note that we do not alter our Site’s data collection and use practices when we see a Do Not Track signal from your browser.

 5.   YOUR RIGHTS

5.1  If you are a European resident, you have the right to access personal information we hold about you under the Data Protection Act 2018 and to ask that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact us here. A reasonable fee may be payable to cover any costs incurred by us in providing you with the information.

5.2  Additionally, if you are a European resident we note that we are processing your information in order to fulfil contracts we might have with you (for example if you make an order through the Site as noted in our Terms of Service 7.4) or otherwise to pursue our legitimate business interests listed above.  Additionally, please note that your information may be transferred outside of Europe, including to Canada and the United States.

6.    DATA RETENTION

6.1   Please note we do not receive or store any payment details you provide using the webstore or i-Zettle credit card machine, payment links or payment by QR Code.  In the event that payment information is shared by you with the artist directly, it will be stored for as long as needed to process payments and deleted from our emails or messages after 28 days or retained for a maximum period of 6 months in line with the terms of the retention of order information laid out below in 6.2.

6.2  The Order Information we receive to fulfil your order (including your name, address, phone number and email address) is kept in order to manage post sales or follow up sales and communication and is kept for a limited amount of time, up to a maximum of six months, or until you ask us to delete this information. 

6.3    When you make a purchase we will keep your name indefinitely in a log of collectors and sales.  The artist may contact you to ask permission for your name, email address, and or address to be added to a ‘collector’s contact list’ which is a retained list of buyers of Lucia Hardy’s work, alongside an option for you to also be added to the regular newsletter mailing list and receive other occasional notices of events and offers events emails. 

6.4    I will take all reasonable care to keep your Order information is retained safely and securely.

6.5    When you sign up for the Artist Journal/Newsletter and or notice of events and offers, I will take all reasonable care to keep your Contact Information safe and secure and will retain it using Mailchimp and a newsletter email data backup, until you unsubscribe or request to be removed from the mailing list.

6.6    When you contact me for information or with an enquiry, I will retain your Contact information safely and securely and reserve the right to contact you on matters relevant to your request/communication indefinitely.  Any information you share will be held securely, treated confidentially and only used for the purposes outlined in this document. 

7.    MINORS

7.1  The Site is not intended for individuals under the age of 18.  Should you suspect a young person has accessed this site and shared information, I would request that a parent or guardian contact me here, to support privacy of children’s data online.   

8.  CHANGES

8.1  We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.
